  • A garnishee order is an order issued by a court, at the instance of the judgement creditor attaching funds in the hands of a third party who owed money to the judgement debtor.
  • The court issues a written order prohibiting the creditor, i . e . the judgement debtor, from recovering the debt and the debtor from making payment thereof until further orders of the court.
  • Proprietorship Accounts : If the customer is the sole proprietor of a firm, the firms account is attached by the order issued in the name of the sole proprietor only as a judgement debtor.
  • Joint Accounts : If there is a joint account in the names of two or more persons, it cannot be attached by a garnishee order served on the bank quoting only one of them as judgement debtor.
  • The sheriff is now largely responsible for enforcing the civil orders and fines of the court by seizing and selling the property of judgement debtors who do not satisfy the debt, providing court security, enforcing arrest warrants, evictions, taking juveniles into custody and running the jury system.
